By registering for the First Response Session, purchasing a VIP Upgrade, enrolling in the Smart Spark Hub membership, or booking an Emergency Call offered by KIDmistry™ and SMART SPARK (collectively "KIDmistry"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, do not register, purchase, or participate in any KIDmistry offering.
These Terms and Conditions constitute the entire agreement between you and KIDmistry with respect to your participation in any KIDmistry session, product, or service, and supersede all prior agreements, representations, or understandings of any kind.
These Terms apply to all products and services offered by KIDmistry™, including but not limited to the First Response Session, VIP Upgrade, Smart Spark Hub membership, Emergency Calls, and any digital products or resources provided by Taji Wright-Fitzhugh, M.Ed and KIDmistry.
The First Response Session is a free, live, 90-minute educational session hosted via Zoom. By registering you acknowledge and agree that:
ALL KIDMISTRY PRODUCTS AND SERVICES ARE PROVIDED ON AN AS IS BASIS. KIDmistry™ makes no representations or warranties of any kind, express or implied, as to the completeness, accuracy, usefulness, or timeliness of any information presented in any session, product, or service. KIDmistry™ shall have no liability for any errors or omissions in any content provided.
Under no circumstances should any content provided by KIDmistry be construed as professional, legal, financial, tax, or accounting advice. The views, information, and opinions expressed during any session are solely those of the individuals involved and do not constitute professional advice of any kind.
The VIP Upgrade is a one-time paid add-on available to registered attendees of the First Response Session only. By purchasing the VIP Upgrade you agree to the following:
Non-Transferability: The VIP Upgrade is available to registered attendees only and may not be transferred, resold, or shared with any other individual.
Refund Policy: ALL VIP UPGRADE SALES ARE FINAL. NO REFUND or other remedy will be provided under any circumstances, including if you do not attend the live session, experience technical difficulties on your end, or are dissatisfied with the content.
The Smart Spark Hub is a monthly membership community offered by KIDmistry™. By enrolling you agree to the following:
Billing: You will be charged a recurring monthly fee at the rate applicable at the time of your enrollment. Founding member rates are locked in at $47 per month for the duration of active and uninterrupted membership. If your membership lapses or is cancelled, the founding rate cannot be reinstated.
After 24-Hour Founding Window: The $47 per month founding rate is available for 24 hours following the conclusion of the First Response Session only. After this window closes, the standard rate of $67 per month applies.
Cancellation: To cancel your membership, you must submit a written cancellation request to info@kidmistry.com at least 5 business days before your next billing date. Cancellations received after this deadline will take effect on the following billing cycle. No refunds will be issued for any partial months already billed.
Access: Upon cancellation, your access to the Smart Spark Hub will continue through the end of your current paid billing period and will then be terminated.
Code of Conduct: Members are expected to maintain a respectful, professional, and supportive environment within the Hub community. KIDmistry reserves the right to remove any member who engages in harassment, disrespectful behavior, or any conduct deemed harmful to other members, without refund.
Intellectual Property: All content, systems, frameworks, scripts, resources, and materials provided within the Smart Spark Hub are the exclusive intellectual property of Taji Wright-Fitzhugh, M.Ed and KIDmistry™. Members may not reproduce, distribute, screenshot, share, sell, or transmit any Hub content outside of the membership community without express written permission from KIDmistry.
The Emergency Call is a 30-minute one-on-one session with Taji Wright-Fitzhugh, M.Ed. By booking an Emergency Call you agree to the following:
If the issue is on KIDmistry's end: If a technical failure occurs on KIDmistry's end that prevents the First Response Session from being delivered as scheduled — including but not limited to platform outages, host connectivity failures, or Zoom technical errors attributable to KIDmistry — KIDmistry™ will reschedule the session at no additional cost to registered attendees. Notification will be sent via email to all registered attendees as soon as reasonably possible.
If the issue is on the attendee's end: KIDmistry is not responsible for technical difficulties experienced on the attendee's end, including but not limited to personal internet connectivity issues, device failures, browser incompatibility, or local power outages. No refunds, credits, or rescheduling will be offered for technical difficulties that are not attributable to KIDmistry.
Attendees are encouraged to test their Zoom connection and device setup in advance of the session. Zoom system requirements and connection tests are available at zoom.us/test.
If you do not receive a confirmation email after registering or submitting payment information, you acknowledge your responsibility to confirm with KIDmistry whether your registration or order has been placed by contacting us directly at info@kidmistry.com. KIDmistry will not be responsible for losses, monetary or otherwise, if you assume a registration or order was not completed because you failed to receive a confirmation. Only you may be aware of any problems that occur during the registration or purchase process.
By registering for or attending the First Response Session or any KIDmistry event, you grant KIDmistry™ and its affiliates the irrevocable right to utilize your name, image, likeness, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of or at the session for any purpose, in any manner, in any medium now known or hereafter developed, including for commercial or promotional purposes, without further authorization from or compensation to you.
KIDmistry™ and its affiliates shall own the copyright in any audio, video, and photographs captured during sessions and events.
The information provided in any KIDmistry™ session, product, or service is for educational purposes only. Nothing shared constitutes a guarantee of specific classroom outcomes, career results, or certification success.
Individual results will vary based on classroom environment, school district, student population, years of experience, and implementation effort. Testimonials and examples shared represent real experiences but are not promises of what you will experience.
No income claims or guarantees have been made. Taji Wright-Fitzhugh, M.Ed and KIDmistry™ make no representations or warranties regarding the accuracy, completeness, or applicability of any information presented. Past performance and individual results shared in testimonials are not indicative of future performance or results for any other individual.
All content, materials, systems, frameworks, resources, and digital products provided by KIDmistry™ and SMART SPARK — including the PreSPARK™ Diagnostic, Smart Spark Hub content, First Response Session materials, workbooks, and scripts — are the exclusive intellectual property of Taji Wright-Fitzhugh, M.Ed and KIDmistry. You may not reproduce, distribute, sell, share, or create derivative works from any KIDmistry materials without express written permission.
In consideration of being permitted to participate in any KIDmistry session, product, or service, you hereby release KIDmistry™, Taji Wright-Fitzhugh, M.Ed, and their officers, agents, and employees (collectively "Covered Parties") from any and all liability, claims, demands, actions or rights of action which are related to, arise out of, or are in any way connected with your participation, including those allegedly attributed to the negligent acts or omissions of the Covered Parties.
This agreement shall be binding upon you, your successors, representatives, heirs, executors, assigns, and transferees.
You agree to indemnify and hold harmless KIDmistry™, Taji Wright-Fitzhugh, M.Ed, their principals, agents, employees, and volunteers from liability for any injury, loss, claim, or damage — including reasonable attorneys' fees — arising out of or related to your participation in any KIDmistry session, product, or service, your violation of these Terms, or your violation of any rights of another person or entity.
Should KIDmistry be required to incur attorneys' fees and costs to enforce this agreement, you agree to reimburse them for such fees and costs.
YOU ACKNOWLEDGE YOU WILL NOT BE ENTITLED TO CONSEQUENTIAL, INCIDENTAL, OR EXEMPLARY DAMAGES OF ANY KIND. Except in the case of gross negligence by KIDmistry™, KIDmistry's total liability for any loss or damage shall be limited to the amount you paid for the specific product or service giving rise to the claim.
KIDmistry™ shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, pandemic, epidemic, government restrictions or mandates, natural disasters, platform outages, internet service provider failures, power outages, labor disputes, or other force majeure events. In such circumstances, KIDmistry™ will make reasonable efforts to reschedule affected sessions and notify registered attendees via email as soon as reasonably possible.
KIDmistry™ may reference or provide information about third-party service providers, platforms, or tools. You acknowledge that KIDmistry is not responsible for any third-party products or services. Third-party services are made available exclusively by each provider and KIDmistry makes no representations about their quality, accuracy, or fitness for purpose.
KIDmistry accepts no responsibility for any damage or delay due to third-party cancellations, technical failures, labor disputes, inclement weather, or force majeure events beyond KIDmistry's control. Any disputes or issues regarding a third-party service must be directed to the provider directly.
By registering and providing your contact information, you agree to receive SMS reminders and email communications from KIDmistry™. You may opt out at any time by replying STOP to any SMS or clicking unsubscribe in any email. Message and data rates may apply.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
By registering for or purchasing any KIDmistry product or service, you represent and warrant that you are at least 18 years of age and above the age of majority in your jurisdiction. KIDmistry does not knowingly collect information from or provide services to individuals under the age of 18.
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
KIDmistry's failure to enforce any provision of these Terms and Conditions on any occasion shall not be deemed a waiver of KIDmistry's right to enforce that provision or any other provision at any time in the future. No waiver of any term shall be effective unless made in writing and signed by an authorized representative of KIDmistry™.
KIDmistry™ reserves the right to revise these Terms and Conditions at any time and without prior notice by updating this posted version. You should review these Terms periodically for changes. Any changes are effective upon posting. Your continued use of KIDmistry products or services after notice of a change constitutes your acceptance of those changes. If you disagree with any changes, your sole remedy is to discontinue use of KIDmistry services. No refunds will be issued based on changes to these Terms.
These Terms and Conditions shall be governed by the laws of the State of Texas, without regard to conflicts of law provisions.
By participating in any KIDmistry session, product, or service, you agree that any dispute or litigation arising from or relating to these Terms shall be determined by binding arbitration only in Dallas County, Texas, under the Streamlined Arbitration Rules and Procedures of JAMS. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. Notwithstanding the foregoing, KIDmistry™ may seek equitable relief in any court of competent jurisdiction.
These Terms and Conditions, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and KIDmistry™ with respect to your use of KIDmistry products and services. These Terms supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the subject matter herein.
By registering for, purchasing, or using any KIDmistry product or service, you consent to these Terms and Conditions in their entirety. You represent that you have read and understood these Terms and that you are legally able to enter into this agreement.
